Copyright Infringement Procedures

1. Upon initial receipt of a report of copyright infringement, the student/faculty/staff member indicated in the report will be sent a letter (including a copy of the original infringement report) indicating that they have seven (7) days to clean their machine(s) of any and all copyrighted material for which they do not have a legitimate reason to possess.  The letter will be sent to the address on file in Information Technology for the individual.  A copy of this letter will be sent to either Student Judicial Affairs or to the appropriate Vice Chancellor/Provost.  In the case of a faculty/staff member, the letter and email will also be sent to the appropriate Local Area Network administrator.

2.     If, within the seven (7) days, a response is received indicating either that the machine(s) have been cleaned or claim to have legitimate access to the material in question, the incident will be cleared .  If the student/faculty/staff member claims to have legitimate access to the material, he/she should produce the necessary documentation to support his/her claim.  If subsequent reports of copyright infringements are received, the userid will be immediately disabled without any notice and the incident will be reported directly to either the Judicial Review Board or the appropriate Vice/Chancellor/Provost.

3.    If, after seven (7) days, a response is not received, the indicated userid will be disabled and the incident formally transferred to either the Student Judicial Review board to be handled according to the Student Code of Conduct or to the appropriate Vice Chancellor/Provost to be handled according to university policy. In the case of a faculty/staff member, the LAN administrator will also be notified.

4.   Recognizing the fact that there are legitimate reasons for needing access to the electronic data available via Peer-to-Peer applications, a student/faculty/staff member may apply for an exemption to these procedures by submitting a request, in writing, to the Associate Director of Information Technology responsible for Network Engineering Services.  In this request, sufficient justification as to why the exemption is required should be provided.
